Every community scheme is different. There are hundreds of community schemes in NSW, ranging from simple rural subdivisions to prestige urban developments with private roads, high levels of security and exclusive recreational facilities such as marinas and golf courses.

Governed by strict legislation and regulations, usually the builder or developer will be the only member of a community association in the initial stage. As lots are sold or further subdivided, membership of the association increases.

Part of the registered community, precinct or neighbourhood plan is a vital document called the management statement. (A precinct is always, and a neighbourhood is mostly, a smaller part of a community scheme.) Every owner in a community, precinct or neighbourhood scheme should be given a copy of the management statement when they purchase their lot.

The management statement is often a large and complicated document that regulates everything that happens. It must include by-laws, plans and other particulars about the location, control, use and maintenance of association property. The management statement may also include by-laws, plans and other particulars about such things as behaviour, preserving the essence of a development and architectural or landscape guidelines. The details of what may and may not be in a management statement are far too extensive to be listed in this brief overview.

The rules governing membership of the executive committee of an association are far more complex than those governing the election of an executive committee for a strata scheme. This often causes confusion when there are strata schemes that are part of a community, neighbourhood or precinct as strata owners may not understand that the legislation and requirements are quite different. Managing an association is often a difficult matter and there is usually far too much work for an executive committee of elected volunteers to administer. This is why you need a qualified, competent manager who is specially trained in the legislation governing community schemes and experienced in solving the complex issues that arise. So in considering a management company for your scheme it is important to choose carefully.
